1Overview of the Service
Maprizon is a platform for capturing, uploading, viewing, and sharing street-level, 360°, and drone imagery. The Service supports two ways to share imagery:
- Open (public) imagery — imagery you choose to contribute to the public map, made available to the community and to OpenStreetMap contributors under an open license (see Section 5).
- Private repositories — imagery you keep private to your organization and the people you authorize.
You decide how each upload is shared, subject to these Terms.
2Eligibility and accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use. We may refuse, suspend, or terminate accounts as described in Section 12.
3Plans, fees, and billing
The Service offers a free tier and paid plans (e.g., Team and Enterprise).
- Free tier. Capturing, uploading, and viewing imagery may be offered at no charge, subject to any usage limits we publish.
- Paid plans. Fees, billing frequency, and included features are described at purchase. Unless stated otherwise, subscriptions renew automatically for the same term until cancelled, and fees are billed in advance and are non-refundable except as required by law.
- Changes. We may change prices or plan features on prospective notice; continued use after a change constitutes acceptance.
- Taxes. Fees are exclusive of taxes, which are your responsibility except taxes on our net income.
- Cancellation. You may cancel anytime; cancellation takes effect at the end of the current billing period.
Enterprise terms may be governed by a separate written agreement, which controls over these Terms to the extent of any conflict.
4Your imagery and content
“User Content” means imagery, metadata, tracks, annotations, and any other material you upload or create through the Service.
Ownership. As between you and Maprizon, you retain all ownership rights you have in your User Content. These Terms do not transfer ownership to us.
License you grant to Maprizon. To operate, provide, and improve the Service, you grant Maprizon a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, process, adapt (for example, to blur faces and license plates, align tracks, and generate derived data), publish, publicly display, and distribute your User Content. For private User Content, this license is limited to operating the Service for you and your authorized users. For public User Content, this license also enables the open-license sharing described in Section 5.
Representations. You represent and warrant that (a) you own or have all rights and permissions necessary to upload your User Content and grant the licenses above; (b) your User Content and its capture, upload, and sharing do not violate any law or the rights of any person; and (c) you captured the imagery lawfully.
5Open licensing of public contributions
When you choose to make imagery public, you agree it is licensed to the public — including Maprizon, the community, and OpenStreetMap contributors — under the Creative Commons Attribution-ShareAlike 4.0 (CC BY-SA 4.0) license, or another open license we designate for a given collection. Others may copy, share, and adapt the imagery, including commercially, provided they give attribution and share adaptations under the same license.
You cannot revoke an open license already granted for copies others have obtained, but you may change a collection's visibility going forward and request removal as described in Section 7. Private imagery is not placed under an open license.
6Acceptable use and prohibited content
You agree not to upload, create, or share User Content, or use the Service, in any way that:
- captures identifiable individuals where they have a reasonable expectation of privacy, including in or around private property, private roads, or sensitive locations such as schools, health-care facilities, shelters, or places of worship;
- infringes intellectual-property, privacy, publicity, or other rights, or violates any applicable law or regulation;
- is unlawful, harassing, defamatory, hateful, deceptive, or intended to surveil or endanger any person;
- contains malware, or attempts to gain unauthorized access to, disrupt, scrape, or overload the Service or its infrastructure; or
- misrepresents the location, time, or origin of imagery, or uploads content you did not capture or lack the rights to share.
We may review, refuse, blur, restrict, or remove User Content we reasonably believe violates these Terms or applicable law, but we are not obligated to monitor content.
7Privacy, blurring, and removal requests
Automatic blurring. Imagery processed for the Service is passed through automated detection intended to blur faces and vehicle license plates before it is made viewable. No automated system is perfect; blurring is provided on a reasonable-efforts basis and does not guarantee that all identifying features are obscured.
Your responsibility. Automatic blurring does not relieve you of your obligation to capture and share imagery lawfully and to respect privacy under Section 6.
Removal requests. Any person may request removal of, or additional blurring for, imagery that depicts them, their property, or other sensitive information, or that they believe infringes their rights. Requests may be submitted to [email protected] and will be handled in accordance with our Privacy Policy and applicable law.
8Third-party services and integrations
The Service integrates with third-party tools and data, which may include OpenStreetMap and its editors (such as iD and JOSM), base-map providers, and optional export to other imagery platforms (such as Mapillary). Your use of those third-party services is governed by their own terms and licenses, and Maprizon is not responsible for them. When you export or publish imagery to a third-party platform, you are responsible for complying with that platform's terms and for the licensing consequences of doing so.
9Maprizon intellectual property
The Service, including its software, design, text, graphics, and the “Maprizon” and “Kaart” names and logos, is owned by Maprizon or its licensors and protected by intellectual-property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights. You may not copy, modify, reverse engineer, or create derivative works of the Service except as permitted by law.
10Feedback
If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or obligation to you.
11Disclaimers
The Service and all content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that imagery is accurate, current, or complete, or that blurring will obscure all identifying information. You use imagery and data at your own risk.
12Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or to protect the Service or other users. Upon termination, your right to use the Service ends. Provisions that by their nature should survive (including Sections 4–5, 9–11, and 13–15) will survive. Open licenses already granted for public imagery are not revoked by termination.
13Limitation of liability
To the maximum extent permitted by law, Maprizon and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to the Service. Our total liability for all claims relating to the Service will not exceed the greater of USD $100 or the amounts you paid us for the Service in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14Indemnification
You agree to indemnify and hold harmless Maprizon and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.
15Governing law and disputes
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in Mesa County, Colorado, and you consent to their jurisdiction, except where prohibited by law.
16Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting the updated Terms with a new “Last updated” date or notifying you in the Service). Changes take effect when posted unless stated otherwise, and continued use after that constitutes acceptance.
17Miscellaneous
These Terms, together with any Enterprise agreement and our Privacy Policy, are the entire agreement between you and Maprizon regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing here creates a partnership, agency, or employment relationship.
